The consequences for DUI offenses are harsh. However, if you are an underage driver and you are caught driving while intoxicated, you’ll soon discover that the laws and consequences are even worse for you. Losing your driving privileges may not even be the worst of it, either. Let’s look at why underage DUI consequences are so harsh.
Several types of laws show leniency for a young perpetrator. DUI laws are not this way. Anyone under 21 is subjected to the same drunk driving laws as an adult and is punished as an adult. This is because a BAC of .08 grams per deciliter is the same for anyone, regardless of age. According to the National Highway Traffic Safety Administration, a BAC of .08 increases the chances of a crash risk dramatically. This is why driving while intoxicated is illegal at this number in all 50 states, the District of Columbia, and the province of Puerto Rico. In Utah, the BAC limit is even lower at .05. Although the laws apply the same way to both drunk drivers who are 21 years old and for those who are younger, some of the punishments are even greater for underage drunk drivers. In addition, in our attorney's experience, there are some added DUI/DWI laws for those under the age of 21 years old. Drivers under the age of 21 with a BAC of .01% or higher will be charged and can face many consequences. This can include license suspension for 30-90 days, potential fines and penalties depending on the details of the case, required 15–30 days of community service, and attendance of alcohol education and highway safety programs at a well-known intoxicated driver resource center.
Young people should keep these consequences in mind when they are faced with the decision to drink and drive. A juvenile lawyer can attempt to get charges dismissed or reduced. However, if there is sufficient evidence, this could be difficult. If your case goes to trial, you might have the option to challenge the legality of the traffic stop, but if there is sufficient evidence that you were intoxicated, that may outweigh other details.
